Update on the German Approach on the Doctrine of Equivalence
The Protocol on the Interpretation of Article 69 EPC provides that for the purpose of determining the extent of protection conferred by a European Patent, due account shall be taken of any element which is equivalent to an element specified in the claims. National courts in the EPC Member States developed different approaches on how to take due account of equivalent elements in patent litigation.
