The 22nd Annual Fordham Intellectual Property Law & Policy Conference will be held April 24-25, 2014. In advance of the conference, we will be posting on some emerging issues in IP to promote discussion in advance of, and during, the conference. We welcome your ideas and feedback in the comments.
Next week, the Fordham IP Conference is pleased to be hosting Chief Judge Gerard F. Rogers, Judge Anthony R. Masiello, and Judge Lorelei Ritchie of U.S. Trademark Trial and Appeal Board (TTAB) who will be presiding over a hearing in Promark Brands Inc. and H.J. Heinz Company v. GFA Brands, Inc., Opposition Number 91194974, at the conference. The opposition action concerns applicant’s intent to use the mark “Smart Balance” for frozen foods, which opposer asserts will cause likelihood of confusion and likelihood of dilution of opposer’s registered mark “Smart Ones.”
The session will also feature a talk by Chief Judge Rogers as well as a panel discussion that will offer practitioners’ views of TTAB practice and a comparison of the TTAB with OHIM Boards of Appeal in the EU.
The session will offer a unique opportunity to observe a TTAB hearing in New York City. We hope you can join us and participate in the appellate trademark practice discussion.
