On November 19, Nicholas Bartelt (Senior Fellow) moderated a luncheon panel at the Copyright Society of the U.S.A. entitled “Maybe Not Fair Use? Maybe Not a Problem: The Many (Other) Defenses Against Copyright Infringement.”  The panel featured Richard Dannay (Cowan, Liebowitz & Latman, P.C.) and Nancy J. Mertzel (Herrick Feinstein LLP) who discussed both the basic fundamentals and latest developments of defenses such as laches, abandonment, statute of limitations, lack of standing, and pre-emption.
